NOTE: You must be 18 years of age or older to sign up for a Swarmr account and use this service.

To Report a violation send an email to abuse@swarmr.com with as much information as possible.

a. All Terms that appear on the Sign-Up Page you use to create your account with.

I. Swarmr cannot be held responsible for the content of pages hosted under our free service. Swarmr does not review pages for content before they are posted, and does not verify, endorse or otherwise take responsibility for the contents of any user-created pages. However, we reserve the right to remove any page from our servers which we determine is in violation of our rules and guidelines. Users are solely responsible for all files contained in their own directory, and can be held legally liable for the contents of their web site.

II. Swarmr may terminate user accounts at any time, without notice for conduct that violates these guidelines, or for any other reason, and may terminate user accounts and delete any and all user information for conduct that Swarmr believes is harmful to the business of Swarmr, or any of its users, or partners. Pages found in violation of these items may be subject to immediate deletion and removal from our servers, and their webmasters subject to banishment from the Swarmr network. The following is a non-exclusive list of content and behaviors that are UNACCEPTABLE on Swarmr.

a. Content that contains or contains links to: the promotion of racist ideals, hate or hate speech, bullying, cyber bullying, harassment, assault, sexual assault, bestiality, the denigration of a specific religion or religious beliefs or religious minority groups, or the promotion of acts of violence or genocide, or terrorism.
b. Content that contains, or links to pirated software, whether for educational purposes or not.
c. Content that has been promoted through the sending of unsolicited email (spamming) or mail fraud schemes, or pages that promote or condone the sending of unsolicited email. Users who utilize Swarmr resources, including email addresses for spam are also subject to prosecution to the fullest extent of the law.
d. Content that commits acts of copyright, trademark, patent, trade secret or other intellectual property infringement.
e. Content that is racist, including content which threatens, or defames others.
f. Storage of log files or non-html content, or any use of space that circumvents the display of advertising.
g. Sites that exploit images of children under 18 years of age or otherwise contain content which involves sexual activity of those under 18 or depicted as such.
h. Binary or executable files, or achieved files eg. ZIP or RAR etc.
i. Content that contains or enables or attempts to sell or otherwise traffic in illegal narcotics (including where the movement across any border which would be illegal), any illegal trade in firearms or weapons or alcohol or tobacco, money laundering, animal products or their parts which are derived from endangered species or otherwise run contrary to local, regional, state, provincial or national animal capture and trade laws or CITES or similar international animal trade regimes, counterfeit goods or money or coin or passes or tokens of any nature, counterfeit documents, stolen goods, stolen e-currency or login credentials, devices which enable cable or satellite signal theft, spyware which operates without the users express consent, stolen credit cards or debit cards, stolen banking information, identity information where the use is likely criminal in nature, hacked login credentials or tools or databases which permit or enable any of the foregoing, solicitations or offers of acts of a criminal nature of any form as would be recognized as criminal by the laws of Nevis.
j. Content that contains or enables or attempts to sell or otherwise furthers or promotes acts which involve criminal harassment, extortion, racketeering, slavery or kidnapping.

III. Swarmr provides free space for user content but makes no implied or express warranties about the reliability of this space or related services. Swarmr is not responsible for any deletion, alteration, or loss of data due to network or system outages, file corruption, accidental deletion, or any other reasons. Swarmr makes no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such.

a. Users are responsible for regularly monitoring and creating backups of their own files, and agree to use the Swarmr resources and infrastructure at their own risk. This service is provided on an "as is" basis without warranties of any kind, either expressed or implied. Neither Swarmr nor its partners makes any warranty with respect to any content, information, services, or products provided through or in conjunction with this free service.
b. Swarmr and its partners make no guarantee of the accuracy, correctness, or completeness of any information on these web pages and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained on our servers; or losses or damages arising from the use of the content or services provided by Swarmr.
c. Swarmr may also link to or include on its web site resources and information provided by 3rd party partners and providers. We do not guarantee the reliability of this information, nor does the inclusion of this information imply our recommendation of these services; it is merely provided to assist you in the creation of your web site and provide added value to our service.
d. You agree to indemnify Swarmr and its partners against any and all claims and expenses, including attorneys' fees, arising from the your use of this service. This expressly includes your responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and any libelous or unlawful material contained within your web site.
e. Swarmr does not censor content, as such users may be exposed to content that is mature, graphic or may contain text or imagery of human sexuality.

IV. Swarmr is advertiser supported. As a result we ask that users be supportive of our advertisers and their advertising which helps make this service free. We make every effort to provide advertising relevant to the content of user web pages.

a. Any attempts to undermine or avoid the display of Swarmr placed advertising is considered a violation of this agreement and the site will be subject to immediate removal.

V. Other Swarmr rules and guidelines:

a. Swarmr has a zero tolerance policy for spam, and material which infringes copyright. Any sites found to contain such content are subject to immediate removal from our service.
b. Each user is responsible for building and updating his/her web page, and regularly backing up any related data.
c. User accounts will be deleted after 60 days if there is no activity on the account, in order to free up unutilized resources.
d. Each user is requested to take only one account. Multiple accounts may be taken, but only if each site contains completely different subject matter.
e. Business sites are welcome and encouraged on Swarmr.
f. You consent to the receipt of e-mail from Swarmr including but not limited to updates regarding new features, news about Swarmr, password resets and other technical issues and or other communications including commercial communications. If you wish to withdraw your consent to such messages you need to follow the unsubscribe link given in our emails.

VI. Swarmr reserves the right to amend or change these guidelines at any time without notice.

VII.. Any use of Swarmr or dispute or claim shall be governed by and construed in accordance with the laws of Nevis, without giving effect to any choice-of-law or conflict-of-law provision or rule (whether of Nevis or of any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Nevis.
